Terms of service.

1. Who we are

QTracks is the brand for the Software. The QTracks brand is operated by Leys Services (Levyn Schneider), a Swiss sole proprietorship at Neumattstrasse 26, 3127 Mühlethurnen, Switzerland. Full operator details are on the Imprint. For everyday contact, write to support@qtracks.app.

2. The agreement

These terms govern your use of the QTracks website (qtracks.app) and the QTracks desktop application (the “Software”). The Software is also governed by the End-User License Agreement, which takes precedence on matters of license scope.

3. Licence & permitted use

QTracks is provided to you free of charge under a non-exclusive, non-transferable licence to install and use the Software on devices you own or directly control. There is no licence key, no account, and no payment. The full terms are in the End-User License Agreement, which takes precedence on matters of licence scope.

You may not: reverse-engineer or decompile the binary except as permitted by mandatory law; redistribute, resell, or sublicense the Software; or remove copyright notices.

4. Updates

We deliver updates as signed builds through QTracks's in-app updater. We reserve the right to discontinue support for end-of-life operating systems with 90 days' notice (Apple's, Microsoft's, and the major Linux distributions' EOL policies are our reference).

5. Warranty disclaimer

The Software is provided “as is.” To the maximum extent permitted by Swiss law, we disclaim implied warranties of merchantability and fitness for a particular purpose. We do not warrant uninterrupted operation or that the Software will be free of defects.

6. Limitation of liability

The Software is provided to you free of charge. To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or production downtime, and our aggregate liability arising from or related to the Software shall not exceed one hundred Swiss francs (CHF 100). These limits do not apply to liability for gross negligence or wilful misconduct, or to any liability that cannot be excluded by mandatory law.

7. Trademarks

grandMA3 is a registered trademark of MA Lighting International GmbH. QTracks is an independent product and is not endorsed by or affiliated with MA Lighting.

8. Governing law

These terms are governed by the substantive laws of Switzerland, without regard to its conflict-of-laws provisions. Exclusive jurisdiction is the competent courts at our registered seat, subject to mandatory consumer-protection venues.

9. Changes

We post material changes 14 days before they take effect. Continued use after that date constitutes acceptance.
